Violations of this type will result in the immediate termination of the offending SmileyHosting account. - Use of the SmileyHosting services to transmit any material (by email, uploading, posting etc.) that threatens or encourages bodily harm or destruction of property is not permitted. - Fraudulent activity: Use of SmileyHosting services to make fraudulent offers to buy or sell products, services, items, or to advance any type of financial scam such as "pyramid schemes," or "chain letters." is not permitted. - Infringement of Copyright, Patent, Trademark, Trade Secret, or Intellectual Property Right: Distribution and/or posting of copyrighted or the aforementioned infringements will not be tolerated. - Third Party Accountability: SmileyHosting subscribers will be held responsible and accountable for any activity by third parties, using their account, that violates guidelines created within these rules. - SmileyHosting accounts operate on shared resources. Excessive use or abuse of these shared network resources by one customer may have a negative impact on all other customers. Misuse of network resources in a manner which impairs network performance is prohibited by this policy and may result in termination of your account. |
- Violation Of SmileyHosting Virtual Accounts: It is absolutely forbidden to host pornographic or nude content or IRC servers on Virtual Server Accounts. Virtual Server Accounts found hosting this material will be subject to immediate cancellation without a refund. - Use of SmileyHosting's disk space for that other than hosting web pages at your domain, is not permitted. (i.e. Do not use our disk space as a virtual harddrive. Do not use our disk space to host images/videos for a site that you have hosted somewhere else.) Any accounts that do not follow these guidelines will be warned, then terminated. - You are prohibited from excessive consumption of resources, including CPU time, memory, bandwidth, disk space and session time. You may not use resource-intensive programs which negatively impact other customers or the performances of SmileyHosting systems or networks. SmileyHosting reserves the right to terminate or limit such activities. - SmileyHosting, has the right to charge penalty fees if anyone abuses our service. - All payments are due on the first of the month. If payment is not received we will suspend your account and will delete all remaining data after 14 days. - Upon accepting these rules agreement you also accept any agreement, contract, or Policies on our website. - SmileyHosting reserves the right to revise, amend, or modify these rules, policies, or agreements. - SmileyHosting does not guarantee that our services will be uninterrupted or error free and will not be held liable for any claims resulting from the use or the inability to use SmileyHosting services including, but not limited to, service interruptions, Internet connectivity problems, unauthorized access to SmileyHosting, domain name registrar problems, DNS caching, Internet bandwidth congestion, power failures and natural disasters. SmileyHosting services are sold AS-IS. By using SmileyHosting, the client agrees to indemnify and hold SmileyHosting harmless against any liabilities arising out of defective products sold to customers from QuickSols Inc. servers, personal injury or property damage caused by products or services sold or distributed from QuickSols Inc. servers, any material that infringes or allegedly infringes on the rights of a third party available from QuickSols Inc. servers, and any material that libels or allegedly libels a third party available from QuickSols Inc. servers. |
